yer but dont forget it only works if your so intoxicated you dont know what your doing , so if you have just had a few drinks and actually know what you are doing you cant claim intoxication , well you could but you would be lying and not many juries are gonna believe you didnt know what you where doing after 2 drinks

also if you dalready had the intentional mental element before becoming intoxicated you wont have the defence , so say you want to murder someone but you drink a load of alcohol to give you the courage and then murder them you will be guilty of murder still with no defence of intoxication


i think it is definatle fairer as it takes into account people having their drinks spiked etc
