Possibly, but remember that they then blackmailed him for money, so that throws a wrench into it as well. I'm not a lawyer, obviously, so I don't know. The articles I've read made it sound like he knowingly did it...

The 'blackmailing for money' part would probably be even though he told them, that they wouldn't go public with it.
