I am writing a term paper about General Patton, and im wondering do you think he could of be sent to jail for treason because he defied British General Sir Harold Alexander plane for the invasion of Sicily and made he own plane against Alexander's order. If General Patton's plane did fail, would it be considered treason? and if it is can someone send me a link to a case that could of been related to this kind of treason.

Technically, he could of been busted for so many violations HOWEVER he was kicking serious *** and the top brass did not want to loose this winning streak, what with everything that is at stake. The military was given a lot more respect and a lot more room to operate back then. More than likely because of the real global threat that was approaching. Best thing for you to do is look at the UCMJ.

Treason? No way. He was inthe US army, not the Brittish army.

From Wikipedia:
"To avoid the abuses of the English law (including executions by Henry VIII of those who criticized his repeated marriages), treason was specifically defined in the United States Constitution, the only crime so defined. Article III Section 3 delineates treason as follows:

Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court.

The Congress shall have Power to declare the Punishment of Treason, but no Attainder of Treason shall work Corruption of Blood, or Forfeiture except during the Life of the Person attainted."

No, not treason but many other UCMJ violations however he would never of been brought up on them, not with the amount of success he was having.
