Are you talking about all software? Seems like that to me.

No, I was just talking about Easy Media Creator 10. Instead of being very vague about how I discovered what the program was doing, I included some specifics. And now you are focusing on that I might (or might not) have burned a file with copyrighted material. And others are calling me paranoid. So, I guess people here are not interested in discussing ”software that secretly monitors the user's behavior”

Noone uses Easy Media Creator 10, and if you do, stop now.

Also, if your ISP is sending you warnings you have only yourself to blame IF your not doing the following.

Using USenet or Private torrent sites/trackers
A torrent client with encryption enabled
Random port each open of the program
Utilizing Peerguardian 2
Using a hardware firewall
Disable Windows firewall

nothing wrong with peer guardian 2 or similar programs, its discretionary; use your own judgment.
