Yes companies that do that should get busted cause they are in violation of the EULA that they have with Microsoft. But then again, they could still be legal cause most companies also deal with Microsoft directly to get software so their license agreement can allow for such tools to be used. Such an an Academic License. These are not the same as a VLK, Enterprise or OEM license. So to say that all companies are in violation cause they are not using VLK software but using SysPrep is not true. They could have a separate License agreement with Microsoft that they are not in violation of and it superceeds the EULA.

For a Home user, it completely violates the EULA and the law. It is different for a business cause you can not say for 100% certainty that you know their license agreement which can easily superceed that of the EULA.
