Help! weird display. Toshiba Satellite a305-s6916

See those sparkle dot things in the taskbar and in the start menu icons, etc? They get very very annoying and sometimes get far worse than the screenshots. Just got this laptop today and i know its not dead pixels or anything.
Toshiba satellite a305 s6916
vista home premium 64 bit.
I also got the windows 7 upgrade disks, so should i just keep on vista or upgrade to 7?

I would say install the 7 upgrade - this may solve the problem if it's software in origin. However if the graphics card is dying, which is a possibility, then

If it doesn't make a difference, try installing the latest graphics drivers.

Says fixes distorted screen images. Possible fix! Will update post when done.

Make sure you have the correct driver for your gfx card.

Ugh, no success. Weird dots still there. Updated video drivers.

If i switch the theme to windows classic, it fixes the problem. But, its ugly. Any ideas?
nvm. when im playing some games, problem is still there. but not on desktop and stuff like in screenshots before.

Upgraded to windows 7. Same problem. Is this a failing graphics card? How do i fix this?
