Very good idea, ask for the harddrive back, if they say its broken, just say you want it back anyways..

Yes, the drive is technically yours as is all of the information that is on it. They cannot keep that away from you and should only destroy/recycle the drive if you have signed a waiver allowing them to do so for you. Get it back and hang on to it just in case.
