I bought 2 Western Digital Caviar RE WD3200YS 320GB

One came DOA, the other one somehow died a few weeks after i was using it, but i dunno what i did to make it die. The thing is is that I am thinking of RMA'ing them back for my money, obviously the one thats DOA i am going to. But the one that i was using had a lot of my personal information and files on it and my computer detects that its there, just freezes and gets a blue screen when i try to reformat it off windows, and if i try to re-partition it through windows setup it just takes a long time to examine it and ends up saying that it cant be deleted or repartitioned. If i send it back will WD be able to hold anything that i have on it against me?
