Faulty video card or juvenile OS?

I'm having some technical difficulties so lets see if tech forums can help me out. I recently built a new rig and it worked fine the first few days and then my video card crapped out so I had to RMA it. Upon it arrival I installed it but didn't use the PC because I planned on formatting it soon because I knew I'd be getting Windows 7 soon. (Microsoft sent it for a Windows 7 party =D) Anyway, I am now having some difficulty running 95% of my games and I cant figure out if it is because I am on a still new OS or because my video card is crapping out again. The reason I'm worried its the video card is because a week after I RMA'd my video card I read EVGA cleaned out Neweggs stock of my card because supposedly they had gotten a bad batch. Oh and as for the difficulties I am encountering, in Batman: Arkham Asylum I cant play the game because the FPS is terrible and in Fallout 3 the game would stutter occasionally but now it just always crashes on startup. Even Plants vs. Zombies is a little laggy. I've downloaded all the most up to date drivers so I dont know what else to try. Is there any way to check that my video card is functioning properly? Any help is appreciated.

This is my setup btw if it matters...
