This is a trial won in advance, they'll even be forced to pay you the lawyer expenses probably.
Go for it, kick them back where it hurts the most.
I Had a very similar story from when I bought a quadbike for like 6,000$ and it just repeatidly broke down, so many times I had to replace it with same model but diffrent quadbike that in the end I demanded the money back [That was part of the original agreement], OR a diffrent model of quadbike, the person refused either one of those.
Then i've sued him, won 10,000$ and lawyer expenses.
