I may be mistaken but I don't think the driver issue is resolved for the 295.

We told you already; the GTX 295.

Difference between manufacturers is warranty pretty much. I like EVGA or XFX because they both cover overclocking and a lifetime warranty. EVGA offers the Step-Up program, whereas XFX offers a double lifetime (transferrable) warranty.
