The "Sandbox" effect. Fact or Fiction?

Do you believe that the ""Sandbox"" effect exists, and if you do, what exactly do you think
 
It seems to me that Google applies a penality to new sites. Maybe if you get tons of backlinks you can beat the system but I had an old website hosted on a crappy free host that was ranking well on some keywords without having tons of backlinks, simply cause it was old.
 
Sandbox happens because you don't have enough quality links pointing your site, thus you don't "deserve" much attention from google's deep crawler. Google is using two crawlers to index the web: one will check just your home page, the other one the entire site. The first comes almost immediately, the other one it's up to your site popularity (oneway backlink, mostly).
