The way Apple sees it, since you're buying the phone with a contract through AT&T, it's not really "your" phone. Though the contract only lasts two years, while updates to OSX and iPhone software will go on forever.

If that's the case, the phone should be marketed in ATT stores as a long term lease instead of "purchase price of x-dollars."

But since it's a purchase, it means you buy it.
If you buy it, it means you own it.
