its not illegal to wardrive, but it is illegal to affilate a network. you can drive around with your laptop running netstumbler and cath tons of access points, but once you connect to them, you may have broke the law. just get permission first. now VICone is right. they are some that are publicly free. those you dont have to have permission because you already got it. :)

that is absolutely true!!!
but why not wardrive with wifi pda instead, that way people wont even mind a slow moving vehicle outside their front lawn.

That's what they do, then when they detect the open network it's time to start the laptop and boot up Linux. :D

Also I believe there's a gadget that was made just to detect open wifi, it's about the size of a USB flash drive. Anyways, it's legal to wardrive but the term always suggest someone is up to no good.
