Random spikes in download speed

Greets,

Every now and then i notice that my download speed would start out at like 1000 KB/sec and eventualy go down to what my usual speed speed (usually at a steady speed, takes about 30 seconds to go all the way down). now this is almost 10x faster then my usual speed. what i was wondering is. what is causing this? it is possible to make it so this always happens, perhaps so it stays up at 1000 KB/sec (or whatever it spikes to)?

would this be illegal if i were to do something like this?

Your ISP is throttling your download speed to whatever package you have most likely; it happens to me occassionally as well when I first start a download on something from a direct server.
 
hmm

so that whole "we're sorry but 1.5 mbps is the fastest in your area until edison lets us put in fiber optics" is just a bunch of BS?...
 
Could also be that it's guaging your transfer rate. Kind of like how if you transfer a bunch of files at once from one drive to another in Windows, it gives you an insane length for the "time remaining" part until it stabilizes out.
