You cant really get caught, just punished. You take a modded xbox online with the chip on they ban your xbox serial number. And supposively now if you have files that didnt come stock on the hard drive you get banned, or if you have more partitions like a F or G. But most all bans can be lifted by calling 4myxbox and saying you cant get onto live.
