Well bearshare and the P2P network isn't illegal...but the activity of users infringing copyrighted material over the network is.
The RIAA and MPAA are trying to prosecute users who infringe copyrighted material, and often you'll find many obvious and not so obvious 'file sharers' who's servers are 'fake' and actually belong to the RIAA and other organisations.
That's why alot of unclean file sharers use PeeGuardian or Protowall to reduce the risk of them having evidence gathered about their activities on P2P networks.
There are just too many unafraid users infringing copyright to deal with.
