Because once the processor is out of the motherboard its no longer over clocked, and shows no evidence of being over clocked although it is damaged, the damage cause by the over clock is no different than the damage that can occur on a defective chip running at stock speed.

No such thing.

Unless there is physical damage like burn marks or crushed pins or cracks or whatever, there is no way to differentiate damaged caused by a defective chip from damage caused by over clocking. You can get a brand new precessor that is DOA and have to RMA it and it could possibly show the same defects as a processor that you burned out OC'ing too much. And if you have OC'd and never damaged the chip at all, there is absolutely no way it could be proven.
