it wont create the partition because It says i have an evaluation copy

You have a few options:
1. Use fdisk. This is a DOS based program ran off a start up disk (floppy).
2. The XP install/boot disk.
Both of the above require a reformat of the hard drive, so you will need to back up any data you want to save and then start from scratch. As far as detailed instructions on using the utilities, just Google it.
3. Partition Magic. Very user friendly utility that allows you to create/delete/modify partitions without reformatting.
As far as how to get the software for free, I have no advice there.
