Gigabyte EX58-UD5 Network Problems

Hey I'm using the EX58-UD5 and the onboard LAN will not work. I'm wondering if I need to flash the bios or what needs to be done to solve the problem. I'm hoping this is a common issue and that it could be solved pretty easily.

Did it ever work?
Is it new with a disc?

It's Windows Vista Home 64-bit. No it's yet to work. Yes it's new and has a driver disk (I installed the drivers from the disk), but no luck yet.

Yes, I tried downloading it and it says the file already exists. But I overwrote it thinking maybe I installed it wrong the first time...no luck still.

If you have an earlier bios version, flash it. If not, does the OS recognize it at all?
