Im looking for a build that can play CoD4/5 on maxed settings at 1440/900, and Diablo/Sims 3 when they come out.

This is the build that I have come up with, if I can make do with less let me know.
Oh, I don't need a case, but I do need an OS. Id like to keep the checkout price under $800 excluding MIR's.

(Really I could make do with a lot less, Im only using less than 100 gigs on my current pc, I just picked this one because its a faster HD, if theres a smaller one thats just as fast id like to see it)

most of your choices are good, just a couple of things tho
1. make sure ur e8400 is a E0 stepping one.
2. thats psu is way overkill, go with either a corsair 450vx or 550tx. Newegg.com - CORSAIR CMPSU-450VX 450W ATX12V V2.2 80 PLUS Certified Active PFC Power Supply - Power Supplies
these psu's are alot cheaper and will run ur system easily.
3. swap over to this ram Newegg.com - G.SKILL PI Black 4GB (2 x 2GB) 240-Pin DDR2 SDRAM DDR2 800 (PC2 6400) Dual Channel Kit Desktop Memory - Desktop Memory only a bit more and is much better. 4gb of ram will benefit you in vista, although it is not absolutely necessary to have it is good to have 4gb.
 
grab a sunbeam core contact for heatsink
since it comes with retention brackets and thermal compound

yeah good call, didnt pick that out, the sunbeam core contact is best cooler atm and is cheap, being made by tuniq also comes with tx-2.
